The rules we both work by.

These terms cover use of this website and the design, marketing and hosting work we do for clients. A signed proposal for a specific project always takes precedence over anything written here.

1. Agreement to these terms

By using kre8ivdesigns.com or engaging Kre8ivDesigns Marketing, LLC for work, you agree to these terms. If you do not agree, do not use the site or the services.

Where a signed proposal, statement of work or hosting agreement says something different, that document wins for that engagement.

2. Our services and scope

We provide branding, digital strategy, creative design, WordPress and custom web development, SEO, online advertising, e-commerce and website audits, plus managed hosting through Kre8ivHosting.

Every engagement starts with a written scope listing deliverables, timeline and price. Work outside that scope is quoted separately before it starts. We will not do extra work and then invoice you for the surprise.

3. Quotes, invoices and payment

Third party costs we pay on your behalf, such as ad spend, domains, stock licences and premium plugins, are passed through at cost and shown as separate lines.

4. What we need from you

Projects stall for one reason more than any other: waiting on content and feedback. To keep a timeline honest, you agree to supply text, images, logins and approvals reasonably promptly.

You confirm that any material you give us, including text, images, fonts and logos, is yours to use or properly licensed. You indemnify us against claims arising from material you supplied.

5. Ownership of the work

On final payment, ownership of the final deliverables created specifically for you transfers to you. That includes designs, page templates, copy we wrote for you and the source files.

We keep ownership of our own pre-existing tools, frameworks, internal libraries and unused concepts, and license them to you for use in your project. Third party components keep their own licences.

Unless you ask us in writing not to, we may show finished work in our portfolio and case studies.

6. Third party platforms

Much of what we build sits on platforms nobody controls: WordPress, Shopify, Google Ads, Meta, payment gateways, plugin vendors. Their terms, pricing, APIs and algorithms change without asking us.

We will keep your site working through those changes as part of a maintenance plan, but we cannot be responsible for a third party outage, policy shift or ranking change.

7. Hosting and maintenance

Managed hosting and maintenance are ongoing subscriptions covering updates, backups, security monitoring and a defined allowance of small changes.

Either side may cancel with thirty days notice. On cancellation we will provide a full export of your site and database so you can move it wherever you like. We do not hold sites hostage.

8. Results and warranties

We will perform the work with the care and skill expected of a competent professional studio. We do not guarantee specific search rankings, traffic volumes, lead counts or revenue, because no honest agency can.

Beyond that commitment, services are provided as is, without further warranties of any kind, express or implied.

9. Limitation of liability

To the maximum extent the law allows, our total liability arising from an engagement is limited to the fees you paid us for that engagement in the twelve months before the claim.

Neither side is liable for indirect or consequential losses, including lost profits, lost data or business interruption.

10. Termination

Either side may end a project in writing. You pay for work completed and costs committed up to that point, and we hand over everything produced and paid for.

We reserve the right to end an engagement where payment is persistently late, where we are asked to do something unlawful, or where conduct toward our team is abusive.

11. Governing law

These terms are governed by the laws of the State of Texas. Any dispute is heard in the state or federal courts located in Bexar County, Texas.

Before anyone files anything, both sides agree to talk. Most disagreements in this business are a conversation, not a lawsuit.
